Parties to a Waqf
Foundational
Concept Explanation
Concept Explanation: Parties to a Waqf
A waqf involves several key parties and elements.
The waqif is the founder or donor who establishes the waqf.
The mawquf is the asset dedicated as waqf. It may be land, building, money or another suitable asset.
The mawquf alayh refers to the beneficiary or purpose for which the waqf is created.
The mutawalli or nazir is the manager, trustee or administrator responsible for managing the waqf according to its purpose and applicable rules.
Each party or element plays an important role. If the founder's intention is unclear, disputes may arise. If the asset is poorly defined, management becomes difficult. If beneficiaries are unclear, impact may be weak. If the mutawalli is ineffective or unaccountable, the waqf may fail to serve its purpose.
Therefore, understanding the parties to a waqf is the first step toward understanding waqf governance.
